AB 885 IMPLEMENTATION 

 

Background

On June 19, 2012 the State Water Resources Control Board (SWRCB) adopted Resolution No. 2012-0032 adopting the Water Quality Control Policy for Siting, Design, Operation and Maintenance of Onsite Wastewater Treatment Systems (OWTS).  The administrative record for the OWTS Policy was approved by the Office of Administrative Law (OAL) on November 13, 2012 and the OWTS Policy became effective on May 13, 2013.   

The policy requires that local agencies adopt the Tier 1 Standards in the policy or create a Tier 2 Local Agency Management Program (LAMP).  LAMP’s approved under Tier 2 provide an alternate method from Tier 1 programs to achieve the same policy purpose which is to protect water quality and public health.   

 

Napa County Proposal

Napa County Planning, Building and Environmental Services, Environmental Health Division is developing a Tier 2 LAMP for review and approval by the RWQCB to allow for the implementation of the OWTS Policy in Napa County. The LAMP will include siting, design, operation and maintenance requirements for both conventional, alternative and winery OWTS.  

 

Napa County LAMP will consist of three parts: 

             Part One:          Napa County Code Chapter 13.16 (as being amended) 

             Part Two:          Napa County Onsite Wastewater Treatment Systems (OWTS) Technical Standards  

             Part Three:        Additional Considerations 

 

Parts one is self-explanatory.  Part two is a technical document and includes one section related to site evaluations, sewer lines and septic tanks, one section each related to conventional systems, alternative systems and winery wastewater systems.  Part three, Additional Considerations, addresses additional Tier 2 Policy requirements that are not specifically addressed by the Ordinance or Technical document.   

 

UPDATE 2/25/2016  

 

PBES staff will take this to the Board of Supervisor on April 5, 2016 to get direction on submittal to the Regional Water Quality Control Board. Your support is encouraged.
